Learnfinity Ltd Training Programs

1. Introduction

These Terms and Conditions ("Terms") govern your enrollment in and participation in training programs provided by Learnfinity Ltd ("we", "us", "our", "Provider"), a registered training provider (UKPRN: 10097136) based in the United Kingdom.

By enrolling in any of our programs, you ("Student", "Participant", "you", "your") agree to be bound by these Terms. Please read them carefully. These Terms form a legally binding agreement between you and Learnfinity Ltd.

2. Definitions

2.1 "Program" means any training course, bootcamp, or educational service offered by Learnfinity Ltd.

2.2 "Career Support Commitment Program" means specifically designated programs that include our Career Support Commitment as detailed in Section 10.

2.3 "Completion" means satisfying all Program Requirements as defined in Section 10.2.

2.4 "Qualifying Interview" means a job interview with a third-party employer for a role related to the skills taught in the Program.

2.5 "Job Search Period" means the 90-day period following Program completion during which the Career Support Commitment applies.

2.6 "Good Standing" means the Student has no outstanding payments, has not violated the Code of Conduct, and has met all Program Requirements.

3. Program Enrollment

3.1 Eligibility: You must be at least 18 years old and legally permitted to work in the United Kingdom to enroll in our Programs.

3.2 Application: Enrollment is confirmed upon signing the Training Services Agreement, completion of any required assessments, and payment setup.

3.3 Start Date: Programs begin on the date specified in your Training Services Agreement.

3.4 Capacity: We reserve the right to cancel or postpone programs if minimum enrollment is not met, with at least 7 days' notice.

3.5 Accuracy of Information: You confirm that all information provided during enrollment is accurate. Providing false information may result in immediate dismissal without refund.

4. Payment Terms

4.1 Tuition Fees: Program fees are as specified in your Training Services Agreement and are non-negotiable once confirmed.

4.2 Payment Methods: Payments are collected via GoCardless Direct Debit or bank transfer as agreed.

4.3 Payment Plans:

  • Pay in Full: Total amount due before or on the start date
  • 3 Monthly Installments: First payment on start date, remaining 2 payments on the same day of subsequent months
  • 4 Monthly Installments: First payment on start date, remaining 3 payments on the same day of subsequent months

4.4 Late Payments: Late payments may result in immediate suspension of access to learning materials and live sessions until payment is received.

4.5 Failed Payments: If a Direct Debit payment fails, you will be notified and given 7 days to resolve the issue. Repeated payment failures may result in removal from the Program.

4.6 Payment Default: Outstanding balances may be referred to debt collection agencies. You agree to pay all reasonable collection costs incurred.

4.7 No Guarantee Eligibility During Payment Default: Students with outstanding payments are not eligible for any guarantee benefits until all payments are current.

5. Cancellation & Refund Policy

5.1 Statutory Cooling-Off Period (14 days): Under UK Consumer Contracts Regulations 2013, you have the right to cancel this agreement within 14 days of the date you signed your enrolment contract.

5.2 Waiver for Immediate Access: By enrolling and accessing any course materials, live sessions, recordings, labs, or platform content within the 14-day period, you expressly acknowledge that: (a) you have requested the service to begin immediately; (b) you will not be entitled to a refund for any services already delivered (including completed live sessions, accessed materials, or used lab credits); (c) refunds within the 14-day period will be pro-rated to exclude services already consumed.

5.3 After the 14-Day Period: After the 14-day statutory cooling-off period has expired, NO refunds will be issued under any circumstances. This includes (but is not limited to) cases of: change of mind, change of personal circumstances, choosing to enrol elsewhere, dissatisfaction with the learning style, or partial completion of the programme.

5.4 Cancellation Process: To exercise your statutory right to cancel within 14 days, email support@learnfinity.co.uk with your full name and enrolment details. Cancellation is effective only upon written acknowledgement from Learnfinity Ltd.

5.5 Refund Timeline: Approved refunds (where applicable under 5.1–5.2) will be processed within 14 business days to the original payment method.

5.6 Payment Plan Default: For students on instalment plans, cancellation of remaining instalments does not constitute a refund of past instalments and is at Learnfinity's sole discretion.

5.7 Provider Cancellation: If Learnfinity cancels a programme before delivery for reasons within our control, you will receive a full refund of all payments made.

6. Attendance & Participation Requirements

6.1 Live Sessions: Students must attend a minimum of 80% of scheduled live sessions to maintain Good Standing and guarantee eligibility.

6.2 Recordings: Missed sessions may be available as recordings, but recorded content does not count toward attendance requirements unless pre-approved in writing.

6.3 Active Engagement: Students must actively participate in coursework, complete all assigned projects, submit assignments on time, and engage with instructors and peers.

6.4 Disruptive Behavior: We reserve the right to remove students who engage in disruptive, abusive, discriminatory, or inappropriate behavior without refund.

6.5 Communication: Students must respond to instructor communications within 48 hours during the Program period.

6.6 Absence Notification: Any planned absences must be communicated to the instructor at least 24 hours in advance.

7. Learning Materials & Intellectual Property

7.1 License: All course materials are licensed to you for personal, non-commercial educational use only during and after the Program.

7.2 Restrictions: You may not share, distribute, sell, reproduce, or create derivative works from course materials. Violation may result in immediate dismissal and legal action.

7.3 Student Work: You retain ownership of original projects and assignments you create during the Program.

7.4 Portfolio Use: We may request permission to showcase exceptional student work in our marketing materials. Such use will always credit you unless you request otherwise.

7.5 Recording Prohibition: You may not record, screenshot, or capture live sessions without explicit written permission.

8. Data Protection & Privacy

8.1 GDPR Compliance: We comply with UK GDPR and the Data Protection Act 2018.

8.2 Data Collection: We collect personal information necessary to deliver our services, including name, contact details, payment information, and learning progress.

8.3 Data Usage: Your data is used for enrollment, Program delivery, payment processing, communication, and career support services.

8.4 Data Sharing: We do not sell your personal data. We may share data with payment processors (GoCardless), email services (Resend), and potential employers with your explicit consent.

8.5 Your Rights: You have the right to access, correct, delete, or restrict processing of your data by contacting support@learnfinity.co.uk.

9. Program Delivery

9.1 Format: Programs are delivered online via live sessions, recorded content, and project work unless otherwise specified.

9.2 Schedule Changes: We reserve the right to modify session times with at least 48 hours' notice. Emergency changes may be made with shorter notice.

9.3 Technical Requirements: Students must have reliable internet access (minimum 10 Mbps), a computer capable of running required software, a webcam, and microphone.

9.4 Support: Instructor support is available during live sessions and via designated communication channels (email, Slack, or WhatsApp as specified).

9.5 Curriculum Changes: We reserve the right to update curriculum content to reflect industry changes. Core learning outcomes will remain consistent.

10. Career Support Commitment

This section applies to Programs explicitly marketed as including our Career Support Commitment.

10.1 The Commitment

If you complete the programme and meet all attendance and assignment requirements but have not secured a job interview within 90 days of programme completion, Learnfinity Ltd commits to providing the following continued support at no additional cost:

  • Ongoing 1-to-1 CV and LinkedIn review sessions
  • Mock interview practice with our instructors
  • Direct introductions to our hiring network where appropriate
  • Continued access to the learning platform and all materials
  • Monthly check-in calls until your first interview is secured

This support continues until you secure your first qualifying interview. Note: This is a support commitment, not a financial guarantee. No refunds are payable under this commitment under any circumstances.

10.2 Eligibility for Career Support Commitment

To be eligible for the Career Support Commitment, you MUST satisfy ALL of the following:

  • Attendance: Minimum 80% attendance of live sessions
  • Assignments: All assignments and projects submitted and approved
  • Job Applications: Documented evidence of at least 20 job applications submitted within 60 days of completion
  • Payment: All instalment payments fully settled
  • CV & LinkedIn: LinkedIn profile and CV approved by Learnfinity before applications begin
  • Good Standing: Maintained Good Standing throughout the Program with no Code of Conduct violations

10.3 What Counts as a Qualifying Interview

A Qualifying Interview is defined as:

  • A first-round or subsequent interview (phone, video, or in-person) with a legitimate third-party employer
  • For a role directly related to the skills taught in the Program
  • That you attended and participated in good faith

10.4 Important Disclaimers

  • No Financial Guarantee: The Career Support Commitment is a support commitment only. It does not entitle you to any refund, credit, or financial compensation under any circumstances.
  • No Employment Guarantee: We do not guarantee you will receive a job offer. Employment outcomes depend on individual effort, market conditions, and factors outside our control.
  • Market Conditions: Past student outcomes are not guarantees of future results.
  • Sole Remedy: The continued support described above is your sole and exclusive remedy in relation to career outcomes.

11. Career Support Services

11.1 Scope: Career support includes CV review, LinkedIn optimization, interview preparation, and job search guidance.

11.2 Duration: Career support is provided during the Program and continues under the Career Support Commitment (Section 10) until your first qualifying interview is secured, subject to eligibility.

11.3 No Employment Agency: We are a training provider, not an employment agency. We do not guarantee job placements or act as recruiters.

11.4 Student Responsibility: You are responsible for your own job search efforts. Our role is to equip you with skills and support, not to find you a job.

11.5 Employer Introductions: Any employer introductions we make are facilitated connections, not job offers. Interview and hiring decisions are solely at the employer's discretion.

12. Certificates & Credentials

12.1 Completion Requirements: Certificates are awarded upon successful completion of all Program requirements including attendance, projects, and assessments.

12.2 Non-Accredited: Unless explicitly stated, our certificates are not accredited by external bodies. They certify completion of our training Program only.

12.3 Verification: We will verify certificate authenticity if requested by employers or educational institutions.

12.4 Revocation: Certificates may be revoked if obtained through fraud, misrepresentation, or significant Code of Conduct violations discovered after issuance.

13. Limitation of Liability

13.1 No Employment Guarantee: We do not guarantee job placement, specific salary outcomes, or career advancement. Past student outcomes are not guarantees of future results.

13.2 Educational Outcomes: While we strive for excellent educational outcomes, individual results depend on student effort, aptitude, and external factors.

13.3 Technical Issues: We are not liable for interruptions due to technical issues, internet outages, or circumstances beyond our reasonable control.

13.4 Maximum Liability: Our total liability for any claims arising from or related to the Program is limited to the amount of tuition actually paid by you.

13.5 Exclusion of Damages: We are not liable for indirect, incidental, consequential, or punitive damages, including lost income, lost opportunities, or emotional distress.

13.6 Third-Party Services: We are not liable for the actions, services, or content of third-party providers including employers, payment processors, or technology platforms.

14. Code of Conduct

14.1 Respect: Students must treat instructors, staff, and peers with respect and professionalism at all times.

14.2 Academic Honesty: Plagiarism, cheating, and misrepresenting others' work as your own are prohibited and may result in immediate dismissal without refund.

14.3 Professional Behavior: Students must conduct themselves professionally in all Program-related interactions, including with potential employers.

14.4 No Harassment: Harassment, discrimination, or bullying of any kind is strictly prohibited.

14.5 Confidentiality: Students must maintain confidentiality regarding other students' personal information and work.

14.6 Consequences: Violations may result in warnings, suspension, or dismissal without refund at our sole discretion.

15. Dispute Resolution

15.1 Informal Resolution: We encourage informal resolution of disputes. Please contact support@learnfinity.co.uk with any concerns before initiating formal proceedings.

15.2 Response Time: We will respond to formal complaints within 10 business days.

15.3 Mediation: If informal resolution fails, parties agree to attempt mediation before litigation.

15.4 Time Limit: Any claims or disputes must be raised within 6 months of the event giving rise to the claim.

16. Changes to Terms

16.1 Modifications: We reserve the right to modify these Terms with 30 days' notice for prospective students.

16.2 Notification: Changes will be communicated via email and posted on our website.

16.3 Existing Students: Material changes do not apply retroactively to currently enrolled students without their consent.

16.4 Continued Use: Continued participation in our Programs after notice of changes constitutes acceptance of updated Terms.

17. Governing Law & Jurisdiction

17.1 Governing Law: These Terms are governed by the laws of England and Wales.

17.2 Disputes: Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17.3 Consumer Rights: Nothing in these Terms affects your statutory rights as a consumer under UK law.

18. General Provisions

18.1 Entire Agreement: These Terms, together with your Training Services Agreement, constitute the entire agreement between you and Learnfinity Ltd.

18.2 Severability: If any provision is found unenforceable, the remaining provisions continue in effect.

18.3 Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it later.

18.4 Assignment: You may not assign your rights under these Terms. We may assign our rights to a successor entity.

18.5 Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.

Student Acknowledgment

By enrolling in our Programs, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You confirm that you understand the Career Support Commitment is a support commitment only and does not entitle you to any refund. You acknowledge that no refunds are available after the 14-day statutory cooling-off period.
